With the dawn of legalized recreational marijuana in California finally upon us, it's time to review the many laws and regulations that casual cannabis consumers should keep in mind as they stroll through the Golden State. While medical marijuana has been legal in California for more than two decades, the passing of Proposition 64 has resulted in a new set of laws that are specific to the recreational market and non-medical cannabis users. California natives and visitors should review these regulations in order to avoid unnecessary fines or possible arrest for the possession, use, or sale of cannabis. Let's have a look at the laws governing the new recreational cannabis marketplace in California:

Proposition D is a city ordinance that protects Los Angeles dispensaries and “grants a limited immunity from enforcement to medical marijuana businesses that do not violate specified restrictions.” Prop D, which was put into effect in 2014, actually bans marijuana within the city except for compliant medical marijuana businesses and, despite common misconceptions, is not a license to sell medical marijuana. It is a defense from law enforcement following federal law that protects Los Angeles dispensaries from prosecution if they are raided and shut down by police.

December 31, 2017

California will implement legalized recreational marijuana on Jan. 1, and there is a provision within the new state law that will essentially erase criminal convictions of marijuana possession. Anyone convicted for possessing less than one ounce of cannabis can have their record reduced or erased in the state. The Washington Post reported that the new law is in line with a movement brewing across the country to eliminate and decrease penalties emanating from the war on drugs as penitence. Minorities have been disproportionately targeted and arrested for marijuana at frightening rates for years, and lawmakers in legal states are trying to make amends.

Nevada went live with legal marijuana in July of 2017, and the state ran out of legally produced and tested marijuana in a matter of days. Washington state went online with rec sales three years earlier and experienced initial supply issues, while Colorado saw lines out of the door clamoring for products which had been sold out in January 2014. With California set to begin recreational marijuana sales on January 1, 2018, many are wondering if there will be a weed shortage once rec sales begin. Let’s take a look at how the recreational weed opening will likely play out.

The California Bureau of Cannabis Control says that the time has come for marijuana legalization. On Jan. 1, recreational marijuana will be legal for adults 21 and older. California is expected to exceed by far the tax revenue brought in by other recreational marijuana states. Colorado brought in around $200 million in taxes for 2016 with recreational and medical marijuana sales, but California is estimated to bring in at least $1 billion in tax revenue with recreational cannabis sales alone.
